Legal systems vary, but if the new hearing is essentially a de novo one rather than a more focused appeal it would follow that the punishment will have to be considered afresh as well.

Higher courts usually bring the potential for higher sentences

More importantly a De Novo hearing means the evidence will be heard afresh. So this is going to drag on for a while before a verdict is reached...oh lovely lovely

That would be good, but a sports lawyer was interviewed on TalkSh!te earlier today and said he understands Maguire might be able to make this go away if he apologises. Apparently he's previously been asked to do so and refused because he said he was the victim. Can't vouch for any of this myself obv.

From what I've understood with Greek cases, if you have the time and the money you can keep appealing these things and keep dragging them through the court. Although it might not be so easy to do this outside of Athens if there are a lot fewer cases. I know someone who is in a legal dispute with a lawyer and they keep on winning but the lawyer is representing himself and keeps on managing to bring it back to court.
