Thought it wasn't a re-sentence but a re-trial? He could be found not guilty this time

Incidentally I once lamped Mr.Justice Flaux for a bit of verbals when we were at school together. We were our year's best performers in French and had a bit of an unofficial competition going. He generally got better marks than I did during term-time but I always got the drop on him come the exams.

A question for the legal minds........If he is found guilt again, will his sentence be extented?

And here was me convinced that you weren't actually a judge.

No. The previous prosecution, trial and verdict will play no part this time. On the contrary, any attempt to introduce them will be severely criticised.

But if he gets found guilty a second time, & a custodial sentence, would time served already under the previous ruling be applied against that custodial sentence?

It would seem grossly unfair if wasn't.
 
I imagine if he is found guilty again then the time he has served will be taken off any new sentence, as at that point (after the verdict) the history of the case and the defendant can be brought into public.

Strictly speaking I would guess that the judge could give a higher sentence than before, in which case Evans could be sent back to jail.

If he is found not guilty, he could apply for compensation for the time he has served. Whether he will get it is another matter though and he quite possibly wouldn't. To be honest I suspect in that case he would simply try to get back to playing football.

I did but I can't remember now and can't find any info on it. Care to clue me in?

I'd be surprised if any time already spent in prison wasn't taken into account

If you commit rape, you're a rapist, that's what the word means. It doesn't matter if you're nieve or not.
 
Basically. one of his team mates picked up the girl, took her back to the hotel and asked if she fancied a 3some. Obviously blind drunk, she said yes, he phoned Evans who went over to the hotel. They both had sex with her and left. Following day she walked into a police station back home on Yorkshire to report her handbag missing. They asked where last had it, who was she with etc. She said hotel in Rhyl with a couple of footballers. She remembered going there with one for sex but that was it. Police phoned them and asked what happened. He told them exactly what happened and they said that wasn't the girl's recollection. She couldn't confirm that she had consented to sex with Evans so the police charged him with rape. She took her story to the papers and the next day bought matching Mini's for her and her mate. As I say, young dumb footballer he may be, but in this instance, I don't believe he is actually a rapist.
