Their point is that, rather than banning the fan in a kneejerk reaction for what is most likely an ill thought mistake, it would be better to educate them. I see nothing wrong with that line of thinking, and I don't see how it has "missed the point"

I've seen plenty of lawyers agree to settlements that puts their client in shitty situations simply because it involved them getting paid by the State. Or else they stop pursuing a case when they unexpectedly get a costs order from a court.
Or my favourite was recently where a legal team were trying to bring a last minute challenge to stop a deportation going ahead. They lost in the High Court, the judge actually told them all you need to do is submit a particular application to the Minister for Justice and it will suspend the deportation (for which they wouldn't be paid) , instead they appealed the case in the hope the Court of Appeal might find for them (in which case they'd be quids in to the tune of about 50k).
They took the bad appeal instead of doing what would actually help their client.

The issue was about whether using a racial stereotype in a banner at a televised football match, and in the nickname for a black football player, was appropriate. Some sensible people said that it wasn't and that it could cause offence, and some ignorant people disagreed. When the sensible people tried to explain why some might find it offensive, the ignorant people got defensive and lashed out. And then a well-known narcissist who works for Rupert Murdoch and is on record as reading The Lying Rag and The Times newspapers every day, showed up and proved, yet again, what a massive cunt he is. And a chauvinist to boot.
