Thats my only worry, thats they try to make an example of him. This incident would never have got this far if it wasn't for Gerrard being in the equation. I've seen people doing worse than this in the school playground.

Yes, it would. I was involved in a similar case. You can't hit someone and expect to escape a charge. An affray charge can also cover a verbal threat or similar so its not like he's just scraping a court case.
Affray is not as serious as assualt. Barton was charged with both.

Its true to say that its not because its Gerrard that its got this far in a legal sense. This kind of thing will tend to go to court.
However its also fair to wonder whether, had it NOT been Steven Gerrard, the complainant would have taken it as far as he has. If you had a scuffle in a bar with some random, you might be tempted to leave it. If one of the people was famous and it opened the door to all kinds of publicity and eventual compensation then you might consider it more worth your while

Unlikely really though. For one, if the victim does not make a complaint the police would never be aware. Bars are certainly not in the habit of calling the police in as this affects their licence when renewal time comes up. Also, even if the police do find out and do investigate then without a statement from the victim it probably won't get through the CPS even if the police do press charges.

If a member of staff, or a sub-contracted staffer not directly associated with crowd control takes a hit then calling the coppers is almost a given, particularly if you either have a firm identification or are holding whomever did it.
Part of it is duty of care (certainly in Australia), in that the bar can be sued if they "wash their hands" of the incident.
I thnk Gerrard's made a c**t out of himself on this one. Getting in to a heated argument over the music that's playing mis just idiotic.
The mate that threw the elbow is the one in trouble. He's the one that esculated it from a verbal argument to physical involvement.
Self defense my arse though.
