You suggested the FA "decided" to use the balance of probabilities , as if it wasn't normal and was specifically picked out for this instance. You've also suggested the FA made the decision, they didn't. The FA bring the charge, the independent panel decide on it.

Beyond reasonable doubt is only used in criminal trials. No criminal offence was being tried here. It was a breach of FA rules.

I read the entire thing. Me and i_rushie were arguing the same points brought up in the hearing. Except much better than our daft dumbshit lawyer could do so.

Suarez got fucked by (a) Comolli and (b) that incompetent fucking turd McCormick who got his law degree from fucking south bank or some shit.
I'm afraid to say they have zero chance of overturning this. It's a fucking mess of a situation (even accounting for the biased spin put out in that report) they fucking left their case on the floor hooked up to a respirator. I could still recover it from that position with relative ease. But there's no lawyer in the country capable of doing that. Fuck me. Poor suarez i feel really sorry for him.

Ferguson is a 70yr old man with the onset of dementia. How the fuck can you just let his statement stand and not call him for cross examination. Even if you are fucking stupid and don't know what to ask (McFuckWit.. i'm talking about you yuo stupid fucking son of bitch), the very fucking least you should do is make him turn up and say "I put it to you that you invented x,y, and z," "thank you, no further questions".

Or failing that, write a fucking letter to the commission saying you reject their statements as being factually true...however you see no value in them being questioned.

But to just let the FA take those statements as given is a fucking joke. And then the objective/subjective/strict liability. McFuckWit stood there and let that point be conceded without a oh my fucking god. Wake the fuck up. what the fuck is he being paid for?

As much as it's a MASSIVE story, it's one i'm bored to tears with and we all just have to move on, accept it, and look forward to Suarez returning hopefully all guns blazing.

It's pretty sad that these incidents happen in Football but it's done now. Lets get on with it.

Really? I would have thought we should fight this all the way. Its 115 pages of shite and Suarez reputation is tarnished forever, because they take the impressive Evras side of the incident. I hope we appeal and take it as far as we can.

I'm fuming. The best way out of this is to contest every word of their written submission. Say that those reasons were not put to us during the hearing, and had they been we would have
(a) contested them because of....
(b) clarified the alleged inconsistencies by....

etc. etc. But McFuckWit looks like he can barely string two lines together. nevermind pick about 115 pages.

the problem is, McFuckWit conceded all of the best grounds for appeal during the hearing. So it's so difficult now to turn up to an appeal and "change your mind" after the fact. He's such a total fucking cunt. Even if he lost those points, at the very fucking least put up some kind of argument. Then a better lawyer in an appeal can say the hearing panel made the wrong decision on those.

But NOOOOOOOOOO. that fucking douche conceded everything. He even fucking AGREES with them about the forearm pinch. Is he fucking serious. Don't they teach you how to defend you client? You know, agreeing with the prosection is generally not the best tactic is it. FUCK ME. FUCK YOU. FUCK YOU McFuckWit. I'd rather take his sorry arse to court for negligence isntead of the FA

No. Evra's side of things went unchallenged by our "lawyer". Suarez' side of things got taken apart with a fine tooth comb (and our lawyer has evidently never heard of chinese whispers, and how third hand information can change, nevermind when it is also being translated to another language, and at one point the "lawyer" even said "yep, you got me, suarez lied about this int he statement"

So, No. It was more like we indicated to the FA that we believed his side, whilst we also though our own account was a lie. Magnificent. Truly magnificent.

I don't want to read it again, but it sounds like Evra had the more detailed version of the footage. So when he made his statement to the FA, they sat down and when through this detailed footage frame by frame. Then due to some "administrative error", that footage was not provided to Suarez with the rest of the documents. He only recieved it later when it cropped up during the intitial investigation. What did our lawyer say? He said oh, no worries that's fine just give me a bit of extra time to look over it.

So that means suarez' initial statement was made after having seen just the sky footage to refresh his memory. then when he got the more detailed footage, he had to alter his statement to fit that. What did our lawyer say about that? Fuck all, and he conceded that suarez lied. Clusterfuck does not even begin to cover this.

Just enjoy the logic here:

-- Evra cited five uses of the word "negro" to the panel
-- Evra told Ferguson after the game that it was used five times
-- Ferguson told the referee it was five times, based on what Evra said
-- This "corroborates" Evra's evidence

"Corroborate" means to support or confirm.

So the fact of Evra saying the same thing twice means that the second time supports or confirms the first?

Lewis Carroll couldn't do better.

I read that Evra was questioned 4 times, but Luis just once. Isnt that really strange? This report stinks to say the least.
Also love the part were they take Marriners word wheter or not Comolli speaks fluent Spanish. Comolli says he can speak Spanish and thats what he told Marriner. Yet Marriner says he heard fluent, si the comission takes his Word for Comollis language skilles. You couldnt make this up even if you tried.

How anyone can support that report is beyond me.

Also what's clear is that negrito was not used just Negro. That has to change the opinion of a few people huh?

For the record there are lots of holes, I do think he said it he knew it would piss off evra.. 8 games is a bit much but a ban was deserved
