“Sudaca” means “South American” but isn’t usually directed in a nice way. It’s usually aimed at South American immigrants; it doesn’t take a great deal of imagination to see how offensive it can be. It’s more difficult to imagine Evra actually saying, in English, “you South American,” as part of his order to Suarez not to touch him.

Winter’s article also referred to another alleged comment from Evra, one he made to Marriner after being booked for a foul on Dirk Kuyt. He wrote: “Evra responded to Marriner’s caution by allegedly claiming: ‘You’re only booking me because I’m black.’”

If racism is a serious charge (which it is) shouldn't calling a referee a racist, even indirectly, lead to (a) an investigation in its own right and (b), if it's disproved, punishment for the player who made the allegation?

Independent Regulatory Commission reach conclusion in Suarez case.



An Independent Regulatory Commission has today [Tuesday 20 December 2011] found a charge of misconduct against Luis Suarez proven, and have issued a suspension for a period of eight matches as well as fining him £40,000, pending appeal.

On 16 November 2011, The Football Association charged Luis Suarez with misconduct contrary to FA Rule E3 in relation to the Liverpool FC versus Manchester United FC fixture on 15 October 2011.

A hearing took place from 14-20 December 2011 before an Independent Regulatory Commission of The FA to consider the charge.

The Independent Regulatory Commission announced its decision on 20 December 2011, which is as follows:

Mr Suarez used insulting words towards Mr Evra during the match contrary to FA Rule E3(1);
the insulting words used by Mr Suarez included a reference to Mr Evra's colour within the meaning of Rule E3(2);
Mr Suarez shall be warned as to his future conduct, be suspended for eight matches covering all first team competitive matches and fined the sum of £40,000;
the [penalty] is suspended pending the outcome of any appeal lodged by Mr Suarez against this decision.
The Independent Regulatory Commission will provide written reasons for its decision in due course setting out:

(a) the findings of fact made by it;

(b) the reasons for its decision finding the charge proved; and

(c) the reasons for the penalty.

Mr Suarez has the right to appeal the decision of the Independent Regulatory Commission to an Appeal Board. An appeal must be lodged within 14 days of the date of the written reasons for the decision.

The penalty is suspended until after the outcome of any appeal, or the time for appealing expires, or should Mr Suarez decide not to appeal. The reason for this is to ensure that the penalty does not take effect before any appeal so that Mr Suarez has an effective right of appeal.

It's not the clubs place to appeal, its the individuals.

Sure they can help him out but I cant see any movement here. Mind you, its a massive precedent.

At least the ban doesnt kick in till the start of the transfer window, clubs can bend us over a barrel for their forwards - WOOP (!)

HOWEVER, It takes the fuckers six days to make a decision and even then they cant disclose the reasons for the decision until later on?!

So surely Evra needs some charge for accusing the ref of being racist then?

I hate the fact Fergie knows full well how to manipulate official procedures.

Like Ross, I'm dying to find out what evidence they used to support this.
 
We'd need to see their written reasons first, to know how to target the appeal, but they can certainly get on with preparatory work now.

As a further appeal is provided for within the FA procedure, we probably have to go through that before taking the buggers to court. It'll be a waste of time - such internal appeals almost always are - but we would probably not get leave to issue proceedings for judicial review until we'd jumped through that hoop.
 
How long was Rooney suspended for for shouting "fuck Off" directly into the SKY cameras with 100,000's of young, impressionable football fans watching?

To be absolutely fair, this is quite common when the reasons for a decision are long and complex.

[/quote]My instinct would say that we wont on the basis that three of the matches at least would be in the Carling and FA Cups.
