Apparently there wa some chap in the lower leagues that was prosecuted by the FA. He got an 8 match ban with 4 suspended (I think). The suspension of punishment was down to the fact he pleaded guilty and expressed contrition. So Suarez could theoretically expect a full 8 match ban.

Probably more than 8 games as the punishment is tougher if you plead not guilty and then found guilty.
 
IF Suarez is found guilty, I suspect we will pursue this in the civil courts. Will a ban be suspended while the case is ongoing in the civil courts?

Anyhoo, I cant fanthom that a guilty verdict will be handed out, the definitions of what the word in question means is to blurry imho.

Hmmm They cant punish him to hard as they would have to do the same with their brave national team captain. However it is probably taken into consideration that Terry comes from a very tough childhood (mother was apparently stealing and his father drinking before e broke through on the big stage and was able to support them both)....
 
It will be interesting to find out what sort of evidence the FA has found, that enables them to bring the charge against Suarez.

We know there is nothing in the TV footage. The match officials don't seem to know anything. If any of the United players backed up Evra's accusations, their evidence would clearly be tainted. De Gea has said openly that he didn't hear or see anything. It's highly unlikely that any of our players would have provided any evidence against Suarez.

In the event that we go to court I'd expect the question of any ban to be the first matter raised. We'd be asking the court to lift the ban at least until the court case had been decided, and then permanently if we win.
 
By the way, if any of Evra's teammates are going to back him up now, I presume their evidence would be seen as tainted. Like why would they not have brought it to the ref's attention at the time?

Any public body's decisions can be subject to judicial review if the court grants leave for an application to be made. Like you I can't recall the FA having been on the receiving end of one before, but it certainly is an option for us (or for Luis personally if that's what the lawyers think best) should it be necessary. He or we could then seek damages as part of those proceedings.
 
Isnt there a FIFA rule that if any club takes its national FA to court they get expelled automatically? I seem to remember reading that once before, but it may have just been a bad dream ...
 
There would certainly be major decisions to be made about how much of a fight we wanted to get ourselves into. The main point I was making was that the option is there.

FIFA's rule would be challengeable in law in the same way BTW, before either the Court of Arbitration for Sport or the European Court of Justice.

In that case I have no idea how many games he can get. Another thing I didn´t know was this:
"An FA spokesman said: ‘The FA has been made aware this evening of an
incident that is alleged to have occurred during the Liverpool versus Manchester United fixture at Anfield.

'Referee Andre Marriner was made aware of the allegation at the end of the fixture and has subsequently reported this to the FA. The FA will now be making enquiries into the matter."

I didn´t know that Marriner had reported this to tha FA (or am I misunderstanding something again)?
 
For me Marriner is crucial to how this goes. Based on what Evra has alleged there was no need to go Marriner during the game or immediately after the whistle was blown because he - as the ref - was fully aware of what Suarez was repeatedly saying. Be that as it may, Marriner chose not to send Suarez off (even though he seemingly had multiple opportunities to do so), then gets implicated/made to look like a dick on French TV. And to put a cherry on top, Ferguson then goes with Evra to see Dowd and Marriner 20 minutes after the game and tells them to put it in the match report. As I've said in a previous post, why didn't Marriner or Dowd ask why Evra was only bringing this to their attention now???
 
Maybe it is a good time to give Luis a 3 game rest, and put it towards any ban he gets. He will benefit from that towards the last part of the season.

Absolutely not. We might only be doing it as a precaution but it would be taken, and painted in the media, as an admission of guilt.
