First kick on the head was definitely accidental. The second on the video is inconclusive. The gif is not working for me!

In Italy though, to stamp on someone's head whilst they're laying on the ground is a sign of affection.

Mario's defence lawyer is said to have video footage of Balotelli kicking all sorts of teammates in the head as a way of greeting them in the morning.

If he doesn't get off and John Terry does, expect everyone to be furious.

I think it is a shame. There is no clear evidence of him kicking out delibaretly. He is out of balance. Even the spurs players shares a smile with him afterwards. This is another Man U favour by the FA.
 
There's crystal-clear evidence of him kicking out deliberately. The movement he makes with his right leg is simply not one which a person trying to steady himself would naturally make.

Apparently Parker's team mates regularly kick him on the side of the head as well.
