Ha, I'm sure Ross can fight his own battles, but I reckon you've really got to let this obsession go. The truth is lawyers love evidence that is reasonably open to an interpretation that is corroborative of his or her client's account. So there's nothing puzzling there, plus, if things were as black and white as you seem to perceive, findings of fact would not be made "on the balance of probabilities".
