We have to negotiate in good faith - that doesn't oblige us too much.

Presuming its similar in the UK, if you want to enforce the term you seek an order for specific performance from the High Court.

1. The courts are closed until October. Whether this would be sufficiently pressing for a judge to sit during the vacation, I don't know.

2. Specific performance is a discretionary remedy, a court doesn't have to grant it even if the case is proven.

3. In order for the court to grant the equitable remedy the person seeking it has to show they've done equity - followed the equitable maxims.

Google the equitable maxims and see how many apply to Luis in this situation !

I would think using the courts to debate the interpretation of "in good faith" may be an exercise in futility, but, as I say, I am a teensy bit thick

Release clauses in contracts in Spain are public knowledge mate. I have seen several clubs announce it on their website when the player signs new deal.

This is different. It is obvious that Arsenal had access to private information in the contract. I dont think they can make the case that they made a multi-million dollar bid based on newspaper rumors. I dont think we can win the case against Arsenal but we sure can make life uncomfortable for his agent.

I think he knows that there's a BIG chance he's going nowhere as always maintained publicly by BR and Henry because no bids matching our valuation came in and we're not going to sell to a direct TOP 4 competitor.

Liverpool should set an example and whack him with a massive fine for bringing the club into disrepute. He must be made to grovel and make a public apology to the club and fans.

Interesting. However the clause is that both parties agree to negotiate in good faith, by definition you can't have a negotiation if there is only one party. So by Suarez having acted first in bad faith, that should avail the club of any obligation at all under the contract. Nothing else makes sense.

What you are saying would require an additional clause to the effect that "if one party fails to negotiate in good faith, the other party must nonetheless continue to negotiate and to do so in good faith". There's nothing like that in the contract for obvious reason.
