A Dallas judge scheduled a 7 a.m. hearing Friday to hear arguments about whether he should lift his restraining order halting the sale of Liverpool Football Club to the owner of the Boston Red Sox for $476 million.
“I want this issue to be resolved for the parties,†said state district judge Jim Jordan in a Thursday court hearing.
Jordan’s decision followed an hour-long hearing Thursday afternoon in which lawyers for New England Sports Ventures described an attempt by Dallas businessman Tom Hicks to block the team’s sale in a U.S. courtroom as "legal foul play."
Hicks and Colorado businessman George Gillett bought Liverpool FC in 2007.
“As the court will learn, this lawsuit is the product of an attempted coup by Hicks and Gillett to circumvent the recent ruling of the High Court of Justice in London that prevent Hicks and Gillett from hijacking the proposed sale of Liverpool FC to new ownership," NESV's lawyers said in filings supporting their position.
Earlier Thursday, a British judge granted an injunction against Hicks and Gillett that could clear the way for the club's sale. High Court Judge Christopher Floyd issued an order against the legal action taken in Dallas.
"This case has no real connection to Texas," Floyd said.
NESV wants Jordan to throw out a temporary restraining order he granted Thursday that halted the sale. They contend Hicks and Gillett are trying to "hijack" the sale.
"Hicks and Gillett, through their desperate and transparent maneuvers, have thumbed their noses at the British court after their arguments there fell flat," NESV argued.
In a lawsuit filed Wednesday, lawyers for Hicks and Gillett called the sale of Liverpool FC to NESV “an epic swindle,†saying that the price was well below the team’s value.
