I'm sure they'll at least attempt it, thought I'm guessing part of our 'case' is G&H appointed Broughton in the first place to sell the club, so their argument probably rests on the clauses/terms within that agreement.

Which seems logical as Hicks is saying the club would be sold one way or the other and his only problem is that it was not enough. So sell it and shout about it later. RBS would be happy with that and in the unlikely event they lost would not blink too hard at having to stump up some compo to get out of it without too much shit sticking to them. They are going to do business with Henry so will make up any losses in that

H+G's QC should have gone to the judge with the conspiracy angle ie. G&H appointed Broughton, but who was really in cohorts wuth RBS to fuck them up all along.

Lord Grabiner describes the owners as "slippery" because they wanted a one week adjournment to that meeting knowing full well that NESV's deadline for their offer to expired on 5 October.

Also, Hicks had a lawyer, Bruce Toth, listening to that meeting via telephone as an observer, destroying their argument that they were excluded from that crucial meeting.

I hope that the courts have a similar rule as the FA. Award case to RBS and fine heavily G+H for bringing up such a frivilious (spelling?) case. Fingers crossed.
