Not really, I think the Judge might feel that Hicks has managed to throw in enough muck to at least warrant a full study of the facts.

I don't agree though; thier case is wishy-washy.

Just delays the inevitable that the club will be sold but will NESV stick about if thats the case and will RBS have the balls to put us into administration in between ?

They don´t have a cause of action against RBS, they just want to invalidate the sale to NESV. The first tactic was by attempting to sack the Board, the latest being them claiming the Board broke the agreement with RBS by not considering an offer which appears to have been made after the acceptance of the NESV case.

If that is the case then they´ll be going home with their tails between their legs soon.

It´s unusual that effectively the party that is claiming the breach of contract (the LFC Board) is the party that is alleged to have comitted it.

2.57pm: Lord Grabiner QC is now speaking on behalf of the Liverpool board. He tells the court the two alternative offers for the club are "besides the mark" as it is the role of the board to find a buyer, so if they decide to go for NESV then so be it

Grabiner QC - alternative offers are "besides the mark" - role of the board to find a buyer, so if they decide to go for NESV then so be it.

In order to drag the thing out to next week for a trial the judge would need to grant an injunction restraining anything changing in the intervening period.

An injunction is not granted in a situation where damages would be an adequate remedy.

3.08pm: In Hicks's letter/witness statement to the court he writes that during telephone meeting the board had at the start of last week (the one which broke down at adjournment), Hicks Jr was involved. Lord Grabiner questions why this happened as "Hicks Minor" is not on the board.

Can't see RBS having the balls to put us into administration especially when the moneys on the table to do the deal once the Cunts have been removed.

is anybody seriously expecting this to be concluded today? I'm pretty sure with what's at stake, the losing side will definitely lodge an appeal. The problem is whether the courts will allow the appeal process to be conducted before the fri deadline. And if not, or if there H+G play the delay game, what happens when 15th comes around and there's still no resolution. This is what H+G is trying for. Why though? To spite, and possibly get -9 pt deduction as their last act of 'revenge'? Or to cause NESV to pull out of the deal and hence reopening the bidders? I really don't know the end game. Any ideas people?

The sale will go ahead and the Yanks will be allowed to attempt to sue for damages later on. I should add a big IMHO at the end here.
