If Hicks does manage to pay off the debt with money from Mill, he is still the owner and they can wait for the fit and proper persons test to go through and then pass it to Mill.

There is no way Mills can get into it now, bt I'm not convinced damages can ruled out.

Mr. Smith of the times said RBS had refused the mill offer on the advice of the lawyers (probably because of the TRO) my hope is they hold fast even if Mill offer to sweeten the deal.

The obvious solution and the one the UK court seemed to be leanining towards was allowing the sale to NESV. If Hicks can show he could have received more from another deal which the board ignored then NESV can pay the difference to him in damages.

RBS aren't selling the club. Just accepting payment for the debt owed by Hicks.

And he obtained the TRO to stall and set up the deal with Mill. That's the story anyhoo.
