LFC SOLD to NESV.

Re: LFC not yet sold to NESV (but we're getting there, maybe...)

What is the point of the hearing this evening? Are they trying to trump the ruling of the British High Court from this afternoon?

Can't find anything new, lads - Just that they were scheduled to regroup in court approx. 2 hours ago, with representitives from both sides present this time...

Pah. Texan media are shite. And do you know why ? Well, you know ......

Re: LFC not yet sold to NESV (but we're getting there, maybe...)

Found this though...

Earlier, legal opinion in the UK suggested the Texas court restriction might be overturned as soon as the court heard evidence from Liverpool's side, having made their decision purely on the evidence of Hicks and Gillett, who were seeking personal damages of $1.6 billion.

Graham Shear, a partner at Berwin Leighton Paisner, described the Texas ruling as a "fairly desperate bid by Hicks and Gillett to prevent the sale"

"It's a slightly bizarre occurrence and I think it will disappear pretty quickly, probably within 24 hours," Shear told Reuters.

Don't think we had confirmation of that before. It's good that we've got the ball rolling in these proceedings. Now let's hope the advice of those two or three US lawyers earlier in this thread is borne out, and the judge does indeed roll over and discharge the injunction.

Anita - I think we're trying to make doubly sure the injunction goes away, if necessary by making this application ourselves should Hicks' lawyers fail to do so.

Avvy, I've got to say I came across a number of occasions in my career on which individuals in this country (whether lawyers or not) sought to put similar non-reasons forward for issuing proceedings in one court as opposed to another.
I know that.

I was saying that it was stupid comments like that which get people making silly comments UNFAIRLY.

Trust DallasRed to go mental though, no surprises there.
Mental? I see...
I really do hope so, Dallas.

I also hope it's clear that I don't think all Texans are morons.

Re: LFC not yet sold to NESV (but we're getting there, maybe...)

The Guardian is still giving updates.

"I've also been alerted to this article by Jason Cuthbert and Gary Thomas. It's a blog from the Dallas Observer which says Hicks and Gillet have failed a contempt of court motion in Dallas against the Liverpool board for violating last night's restraining order"

Re: LFC not yet sold to NESV (but we're getting there, maybe...)

This is the country that allowed George Bush to be president after a court ruling.
I'm holding tightly onto my cautiously optimistic hat.

Some of the "thinking" behind Hicks' decision to enter a Dallas court...

Steve Stodghill, a lawyer for Hicks and Gillett, said the Texas court had jurisdiction to halt the sale because of all the defendants' business connections to North Texas.

Among the factors that give the Texas court a say: The Royal Bank of Scotland solicits business and has a registered agent here; Broughton had meetings in Dallas with Hicks; and the Red Sox play the Texas Rangers each year in Arlington, Stodghill said.

"It is totally fair for us to pull RBS and the defendants into a Texas court," he said, adding that Hicks picked state court over federal court mostly for speed.

The local newspaper is at www.dallasnews.com, if anybody wants to search through the site - There's not a lot of new stuff there...
Comments like these are the reason people unfairly regard Texans as being morons.
Yeah that plus theyre all fucking morons.
who take it up the arse. Cos of the pledge like.
That has not been confirmed at this point.

Of course it is, Avy - I just think that there ARE plenty of reasons (see Amy's 'Grandfather', through marraige, for example) that 'outsiders' would think so, without using idiot lawyer-speak to prove your point...
