Adrian Mutu must pay Chelsea £14m after losing appeal


Mutu's career had been tainted since he tested positive for cocaine in 2004

Former Chelsea striker Adrian Mutu has lost his final appeal in a five-year legal battle and must pay the club £14m in damages for breach of contract.
The Swiss Federal Court confirmed on Monday that they have upheld the decision made by Fifa and the Court of Arbitration for Sport.
Mutu, 31- who now plays for Fiorentina - was sacked by the Blues in 2004 after testing positive for cocaine.
Romanian Mutu received a seven-month worldwide football ban.
The English Premier League club then set about suing him in order to recover the £15m they paid to sign him from Parma in 2003, which they now look largely set to achieve.
Switzerland's highest court issued the following statement: "The Swiss Federal Tribunal has rejected the appeal filed by Adrian Mutu against a sentence by Cas.
"The Cas had sentenced the professional Romanian footballer to paying a sum of more than 17 million euros to his previous employer, Chelsea Football Club Limited."
Last year, Cas upheld Fifa's ruling for a breach of contract - which Mutu described as "inhumane and unjust" when it was issued in 2008.
The compensation figure, based on lost earnings, was calculated on the length of time Mutu's Chelsea contract had left to run, and was the highest handed down by Fifa.
After serving his ban, Mutu joined Juventus in January 2005 and at the end of the following season he moved to his current side Fiorentina.
When Fifa announced its verdict in 2008, Chelsea welcomed it, calling it "a very significant decision for football".
The Blues have made no comment on the decision of the Swiss Federal Court.
 
yeah it never seemed to make sense. That said I don't think Mutu has been spotless ever since then either

Being a professional athlete (and granted access to the best trainers and physicians to achieve peak physical fitness) isn't the same as some Lindsay Lohan slapper snorting coke off her boyfriend's nads.

I think he deserves everything he gets. He has an obligation and is paid more money than most of us can dream about.

Exactly. He's still playing at a reasonably high level and they haven't seen fit to bin Ashley Cole or John Terry. Mutu made a colossal mistake but got cut loose pretty easily.

That's a silly comparison, Cole and Terry made mistakes but neither of their mistakes prevented them from playing football for a season.

Personally I think the whole thing was self inflicted and he deserves everything he gets.

With the transfer system the way it currently is I don't see why clubs should be punished when a player breaches his contract so blatantly. Mutu signed for Chelsea for around £16 million, Mutu failed a drugs test knowing full well that he would be unable to do what he was purchased to do, why should Chelsea be punished for his act of stupidity?

I think there is an underlying argument that players should not be treated as commodities, but given the current system I think Mutu is the one that is in breach of contract and should be liable for the costs Chelsea have incurred.
 
Or maybe Chelsea could have helped and supported him with his problem/issue as I'm sure they've supported other players of theirs recently. Don't get me wrong. He's a moron for doing it and getting caught but I doubt he's alone. Chelsea didn't have to sack him they had other options. They chose to sack him. If he'd have been in form at the time it would have been a different story. Now I don't know how much Arian Mutu earns but suffice to day I doubt he can afford £15m. He fucked up, no doubt about it, and his bad relationship with Mourinho probably didn't help but Chelsea showed no duty of care or compassion for one of their players who's made a mistake, albeit an immensley stupid and big one. He used a recreational drug FFS not a performance enhancing one. We all make mistakes, some bigger than others but Chelsea took their pound of flesh by sacking him and then wrung him out by demanding compensation. They could have stood by him or sold him and at least gained some of their financial outlay back - which, in real terms to those super rich cunts, was fuck all anyway.

Mutu behaved like a cunt I agree but Chelsea have behaved like bigger cunts when they really didn't need to

i agree. i can see that he should perhaps be liable for wages earned and any direct costs of sacking him such as legal fees, but making him pay back the transfer fee when he wasn't even party to the contract seems nuts. you could argue that it's chelsea's responsibility to judge a player's character when signing. also, isn't there a legal duty for them to take steps to limit their loss, namely by trying to rehabilitate him?

this is like one of us being sacked and being forced to repay recruitment fees, which can easily exceed £10k. unthinkable, basically.

Youre absolutely right. It implies the player has a say in establishing their own value ie that he chose to be valued at 14m.... what happens if Messi "chosses" to be valued at 35 euros, are the club going to listen then? No.

I would guess what Chelsea have argued is that Mutu was aware of his value when he signed the contract, and as such was aware of his liability
 
well i suppose we're going into areas such as whether he could have reasonably been expected to forsee chelsea's loss (i'm guessing, i'm certainly no lawyer) and, i suppose, in the strictest possible sense, he could have.... still seems a completely disproportionate & vindictive punishment though.
