This from Jim Boardman on Anfield Road earlier this evening (hope it's ok to paste this in, in order to clear up any confusion re - the various cases) :

'As reported earlier, the court battle between Liverpool FC’s co-owners and the Royal Bank of Scotland was escalated by the bank earlier this morning in the wake of what Anfield Road understands was overnight counter-action by Tom Hicks.

The story last night was that today’s session – which was actually RBS v Hicks and others – was little more than a discussion between lawyers to discuss the process and to agree times and dates. RBS had taken this action because Hicks had tried to interfere with the board, something that RBS and LFC contend he doesn’t have any right to do.

We were informed this afternoon that Tom Hicks had counter-sued Martin Broughton, Christian Purslow, Ian Ayre and RBS overnight, claiming they had not acted appropriately in terms of accepting the bid from NESV.

As a result, what had been expected to be a low-key minutes-long meeting of lawyers became a full-blown battle between the various legal representatives appointed by not only RBS and Hicks but also by Liverpool FC and other interested parties.

The day in court ended late this afternoon with a decision that the verdict will be announced at 10am tomorrow.

Anfield Road understands that Martin Broughton, Christian Purslow and Ian Ayre will all be in attendance at the court tomorrow. Tomorrow is being seen as the big day supporters have been waiting for and “could be an important step forward for LFC†– if the judge rules in favour of RBS.

Summary is expected to last up to an hour and although this remains the Royal Bank of Scotland’s case a victory for the bank would be seen as a major step for Liverpool FC.

Anfield Road was assured earlier that there was never any intention to dissuade supporters from being there for the trial. We were assured that this was quite the opposite of what was wanted.

We said that as soon as the date, time and location of the trial were known the details would be released and relayed to supporters.

The message Anfield Road had heard was quite clear – if fans were going to take time off work and spend their hard-earned cash travelling to the court to show their support for the club, please turn up on the right day.

Tonight’s message is also clear.

Tomorrow is the big day: Royal Courts of Justice, London, 10am, Wednesday 13th October 2010.'

Seems like a definitive decision will be made tomorrow.

When was the last time it was fun to be a Liverpool fan? 2005 i suppose. New manager, sexy new players like Alonso and Garcia, players like Mellor, Pongolle and Le tallec looking like they may be alright after all, European cup win.

Thats going to be 6 years ago at the end of this shitfest season.

It reminded me a little if when I used to 'watch' the football on teletext. It was great getting updated hoping for a victory but just not knowing. The updates from twitters, it was good on here as there some decent banter most of the way through. Here's hoping for a positive result early tomorrow, problem is I have a lesson in the morning so will have to listen to it on radio in school car park!

Paddy Shennan watches Liverpool FC’s future unfold at the High Court

IT had to be the strangest most surreal away day in the history of Liverpool football club.

Fans and reporters were there (although the latter outnumbered the former) but there wasn’t a player in sight. Or even a hotdog stand.

What kind of football venue was this?

It was all kicking off in the genteel surroundings of The Chancellors Court (court 16) in the Royal Courts of Justice on The Strand, London WC1.

There may have been some national game or other going on in the capital on the same day but, for many, this was the only game in town.

There would be an early kick-off but it wasn’t all going to be about 90 minutes. Unfortunately. It was, we were told shortly after 10.30am, going to take around two hours.

Two hours which could shape the entire future of Liverpool FC. Or maybe not. No one in court – except, perhaps, Mr Justice Floyd and the legal eagles (great name for a band) – knew what the outcome to yesterday’s proceedings was likely to be.

In the event, there was more than four and a half hours of complex legal argument and the case was to go into extra time with Mr Justice Floyd ending proceedings at 4.47pm by declaring he proposed to give his judgement at 10.30am on Thursday.

At 8.30am, the ECHO was greeted by a massive neon sign outside the High Court saying "expect delays". It referred to traffic routes in the Clogged Up Smoke but it was obviously some Cockney joker making a comment on what was about to unfold over several hours.

Just to underline the comprehensive, all-human-life-and-all-cases-under-the-sun nature of these courts, notices confirmed that LFC would be sharing the courtroom agenda with the July 7 inquests... and a libel case involving Peter Andre and Katie Price.

One journalist asked: "Two big t*** in court 14... do you think Tom Hicks and George Gillett could be directed there by mistake, should they turn up here today?"

9am: With The Strand’s pavements full of reporters and camera crew, the court’s gates opened. A few minutes later, the ECHO formed the head of what shortly became a very long queue of journalists.

9.15: No need to panic. If it all goes wrong, we are told that prayer rooms are located in the East Block and in the new Queen’s Building. Again, perhaps we could find Hicks and Gillett in there.

9.35: A friendly female court usher appears AND she’s a comedian: "What are you all here for... Is it Everton?"

9.50: Another female usher explains that there are a total of seven applications to be heard and Mr Justice Floyd will decide the running order. Then she gives us the good news – the first 30 reporters in the queue will be seated in the gallery above the courtroom. Cue an unseemly scrum as reporters jostle for position. Gentlemen of the press? I’m not so sure.

10am: We’re inside and – typical – the roof of a side entrance below me provides an obstructed view. But as a Goodison Park regular it’s really OK because I’m used to it.

The courtroom below, with its rows and rows of books, stained glass windows, imposing white stone walls and ornate, part-wood, part-glass roof, makes the place look part-chapel, part-library and part-courtroom.

10.10: Hicks and Gillett’s man, Paul Girolami QC, takes his position – looking very cheerful, very confident and maybe even a little smug. 10.15: Is that Walton MP Steve Rotheram? Yes, I think it is.

10.21: Enter Liverpool FC’s men, including chairman Martin Broughton, managing director Christian Purslow and Lord Grabiner QC. The veteran legal heavyweight is looking distinguished, self-assured and relaxed.

10.28: "Court rise!" We’re off, as the judge hears the various applications and decides on the running order. Royal Bank of Scotland plc versus Hicks and others will be third up, with the suggestion being it will kick off at 11am and could be over in not much more than two hours. Ha ha.

11.13: We’re in business.

Richard Snowdon QC for RBS is up first and immediately on the front foot he says: "This case, as far as the bank is concerned, concerns what is now an admitted and calculated breach of contract by Mr Hicks and Mr Gillett," before going on to talk of the Americans’ "breathtaking arrogance".

He then went on to say Hicks and Gillett were "seeking to profit from the confusion their actions had caused".

The only shame was, with so many people in the courtroom and so much noise being caused by so many papers being shuffled it was difficult to hear all the evidence and exchanges. It is probably about time the High Court invested in more powerful microphones, while it didn’t help that Mr Justice Floyd must be one of the most softly spoken judges in history.

We often descended into a financial fog but Snowdon was launching wave after wave of attack – surely it was just a matter of time before the judge stopped an unfair fight. But no.

12.17: And it’s Mr Girolami’s turn to speak (overlooking his previous interjections). He even showed he had a sense of humour – as well as a sense of reality: "I don’t have any friends in this court today." Friendless or not he went on to give a standout performance over the next 43 minutes (the undoubted man of the match so far). He raised enough questions and cast enough doubt to make many others feel there was no chance this case could be resolved today.

He talked about rival bidders to New England Sports Ventures – Meriton from Singapore and Mill Financial. The Meriton bid apparently totalled £320m while Mill Financial was to repay RBS and make a firm commitment to finance a new stadium up to the sum of £100m. Just £100m? Really?

12.40: A court official stifles a very big yawn – perhaps he was a Chelsea fan. Or as we were in London, a Manchester United fan.

To be fair it had been a long morning, which also explained why there was evidence of cramp and dead legs among the smattering of Liverpool fans standing at the side of the court.

As we broke for lunch at 1pm most observers were agreed – a very complicated mess had just seemed to get more complicated and messier.

After 2pm it was as if Girolami was trying to undo all his good work – he went on and on and on about the LFC directors allegedly forming a sub-committee. But, with the judge often interrupting him for clarifications, it was clear he was losing his audience.

At one point he even confessed to going down a blind alley. Yes, he had really had a game of two halves.

2.46: Lord Grabiner, although also dealing in fine detail, somehow seemed more authoritative than his now failing rival. He even got some laughs as he made various attempts to pronounce the name Gillett.

He also accused Hicks and Gillett of "slippery behaviour" claiming that the two other bids for LFC were to expire on October 5.

3.44: Lord Grabiner’s colleague, company law expert Philip Marshall QC, says the picture presented regarding the merit of bid is highly misleading as the offer provided was put forward after the company had seen the offer from NESV. On October 5, he added, the merit of the bid for further discussion was significantly less than that put forward by NESV. He also said Mill Financial was not prepared to continue the bidding process without having exclusivity while its offer fell significantly short of the others.

The afternoon degenerated into utter tedium (unless, that is, your hobbies include company law) with arguments of the morning and early part of the afternoon being revisited and picked over by the various QCs.

But then, finally, came some important words from Mr Justice Floyd. At 4.47pm with many in the court in danger of falling asleep, he said (very quietly): "I propose to give my judgement at 10.30am tomorrow."

Outside the court, a few dozen Liverpool fans sang anti-Hicks and Gillett songs while they pondered returning tomorrow.

Justin Room, 37, from Runcorn, said: "I’m not surprised there was no decision today. As a fan all I could see were benches of people scribbling. It’s just their job. Everyone is agreed, including Hicks and Gillett, that the club is about to be sold so why the talk of injunctions.

"Hicks and Gillett don’t give a s*** if we have a nine point deduction. If there was a jury this would all be sorted out quickly and the club would be sold."

Philippe Kasiama, 49, a London-based Parisian, said: "I have supported Liverpool for 35 years and I think they will win their next game tomorrow. It was a bit dull in there today but Hicks and Gillett have got nothing – they’ve got no case. All they did was borrow money. They club will be sold soon."

So, no penalties – but it would go into extra time with the referee deciding to sleep on it.

At the end of this saga I think some of us can qualify for a post graduate degree/master in commercial and company law, basing the thesis on the RBS v G&H re LFC.

Regardless of today's outcome, even if we are sold to NESV, this could drag on for months:

9.42am: As Paul Kelso says, today is very unlikely to bring an end to this saga:

Whoever loses is certain to appeal. Hicks and Gillett have launched their own counter-suit against RBS and the board, while Broughton and the club have begun proceedings for a separate declaratory judgment approving the sale to NESV. Meanwhile the three potential buyers - NESV, Peter Lim and Mill Financial - could seek damages if their ambition to control Liverpool is frustrated.

9.53am: Something cheerful for Liverpool fans to contemplate. The post-Hicks Texas Rangers won their first ever post-season series last night, to reach the American League Championship Series. If they beat the Yankees they will play in the World Series. There is life after Tom Hicks. And whatever happens over the coming minutes, hours, days, Hicks is fairly certainly going, that much was clear from court last night.
