Two things there, neil:

1. A verbal agreement can constitute a contract too, provided the existence of all the legal elements of a contract can be proven; but

2, In any case Broughton said in those interviews earlier that the provisions he's relying on WERE set down in writing.

He stated earlier that it was written into both his contract and the board level paperwork (articles of something or other).

He's really very bullish about the whole thing and I have faith in his judgement.

I think it had something to do with RBS wanting to force the sale through, and that being one way of doing it.

In any case, though, he's in a small minority. Few commentators think LFC itself would be affected, though Kop Holdings might. That's the basis on which those previous announcements about us not taking the usual 9-point penalty were made. I can't see NESV having gone through with the deal if they thought administration was just around the corner.

Ah, I see what you mean. Broughton did make a comment about the bidding process being 'competitive' and that proving that they'd got 'market prices' for the club. So in other words if the other bid was actually a nonexistent, phantom bid, then they could be found guilty of stitching up the owners?

IMO you fellas are overcomplicating this issue, which is more likely to help Broughton and the board than to help H and G. For one thing, how likely do you really think it is that Broughton would have lied through his teeth about the existence of the other bid? For another, from what Broughton said both bids were quite far advanced and it'll be pretty clear what the other bidders were offering. The fact that the board still went for NESV would suggest that the other bidders' offer can't have been much (if at all) more lucrative than NESV's, i.e.there's unlikely to be anything there to bolster Hicks' argument that the club was undersold.

Well, admittedly it's unlikely that a hugely successful businessman who's spent the last four months talking to lawyers and plotting his endgame in elaborate detail would know more about the likely outcome of this particular court case than you, Spider-Neil, a poster with spelling issues on a small internet forum called Six Crazy Minutes, but nevertheless, I think I'm going to back his judgment anyway. Call me an optimistic fool if you will...

He would have a point, but it wouldn't be enough. The answer - on which I'm sure Broughton and the others have taken advice - will be that acting in the owners' interests would have seriously damaged the club and therefore would have been a breach of the directors' own legal duties.

Broughton hasn't said it's "cut and dried". On the contrary, he's said that the outcome of the court case remains to be seen. What he has said is that he's confident that the outcome will not be in Hicks' favour, and he wouldn't have said that without the best advice available.

it's got bugger all to do with spelling errors and my standing on the 6CM board (what's that got to do with anything).
when hicks goes to court his case will be the board should attmept to act in his interests as well as the clubs. you want to come out with smart arse answers be my guest but hick's lawers will be arguing the case not me.
