Any legal eagles flying by ?

Just had a letter from a debt recovery agency in respect of a penalty fare notice, looking for some advice..

Addressed FAO: 'Myself' parent/ guardian of 'My daughter'


It continues; Our client advised us that on Wednesday, October 2,2013 you were issued with a penalty fare by Merseyrail for travelling in breach of the bye law requiring you to have a ticket...

Now correct me if I am wrong.. but would I be right in saying I am not liable ? as Penalty Fare legislation refers to the 'Person' who committed the alleged offence... And as I was not the person who committed the alleged offence therefore they cannot pursue the debt, and they cannot look to claim the debt from my daughter as she is a Minor..

Also if they where to issue civil court proceeding it has to be done with in 6 months ? Any longer and I assume you can have the case chucked out, as the time limit for bring forth proceedings has elapsed.

However can they only do that against my daughter for civil proceeding when she is 18 ? (In 6 months she is not 18)

Now my daughter uses a term time pass but she was pass the cut off time which she was unaware of.. She thought it was 9pm not 8pm as previously she had been let through by the station ticket collectors... Imho discretion should of been given, they just like to act the cunt these ticket officers.. As she travels using the term time pass every single day, on this particular day she had to stay behind in college a little longer due to rehersals... But no... they issued her with a penalty notice which I thought was a little unfair.....
